The Owner agrees to let on hire the goods to the Hirer and the Hirer agrees to take the goods from the Owner subject to the terms and conditions set forth hereunder.
COMMENCEMENT
The hire of the goods shall commence on the date specified on the Equipment Form.
PAYMENT
The rent shall be paid in full or calendar monthly in advance. If the Hirer has an account with Filter Fresh – Kimberley Pty Ltd. Then the terms of payment are as instructed by the given invoice. Increase in rentals will be given in writing.
SUPPLY OF THE WATER
The Hirer shall use exclusively water bottled and delivered by the Owner or one of its agents in the goods hired. PLEASE NOTE: Under no circumstances is the Hirer to use the bottles for any other purpose. Do not put any other matter into these bottles, for example, tap or bore water. If bottles become damaged or lost, the Hirer will be charged a fee to cover the replacement cost.
CONDITIONS OF GOODS
The Hirer agrees that the goods hired are of a size, design and capacity suitable for their purpose and that the Owner has made no representations or warranties with respect to the suitability or durability of such goods for the purpose of and uses of the Hirer or any other representation or warranty expressed or implied with respect thereto. The Owner shall not be liable to the Hirer for any loss, damage or expense of any kind caused directly to the unit hired of the use and maintenance thereof by any interruption of service, of loss of thereof, or for loss of business or damage what so ever or however caused.
INSPECTION & MAINTENANCE
The Hirer shall permit the Owner its servants or agents to enter at all times upon the Hirer’s premises to inspect the goods. The Hirer will keep the goods in proper and properly secured premises and protect them from the weather. The Hirer will not create or allow to be created or acquired any lien on the goods or part thereof. The Owner will at its own expense maintain and keep the goods in good working order and repair. In the event of any damage occurring to the goods, the Hirer shall immediately notify the Owner giving full details thereof and providing such further information as may be required by the Owner.
INDEMNITY
The Hirer indemnity the Owner and keep the Owner indemnified at all times against loss by seizure, under distress, for rent execution or other legal process, loss or destruction or damage to the goods by fire, accident or any other cause whatsoever and any claims arising out of the use, operation or keeping of the goods.
ASSIGNMENT
Neither this agreement nor the Hirer’s rights shall be assignable except with the Owner’s prior written consent. The Owner shall not unreasonably withhold such consent.
DEFAULT
Should the Hirer fail to observe or perform any provision or term of this agreement it shall be lawful for the Owner to take repossession of the goods and for the purpose enter upon or into any premises where the same may be and the determination of the agreement under this clause shall not affect the right of the Owner to recover from the hirer any monies due under this agreement or damages for breach thereof and all cost and expenses incurred by the Owner in exercising or attempting to exercise its rights under the clause shall be paid by the Hirer to the Owner on demand.
TERMINATION & PAYMENT
Termination of this agreement by either party shall be four (4) weeks written notice after the completion of the signed contract period. All monies due shall be paid calendar monthly in advance in such manner as prescribed by the Owner.
